SUBJECT: Pre-Appeal of the Planning Commission Agenda of August 10, 1998 and the Administrative Hearing Agenda of August 12, 1998

REPORT IN BRIEF

This report represents Planning Commission and Administrative Hearing items that may be pre-appealed by a majority vote of the Council. Council should indicate those items on which it wishes to have expanded notification.

A. Pre-Appeal of the Planning Commission Agenda of August 10, 1998

1. Lockheed Martin Missiles and Space: Applications for related proposals for property located at 1111 Lockheed Martin Way in an M-3 (General Industrial) Zoning District. (APN: 110-01-023, 024) (Mitigated Negative Declaration) GP

1998-0619 – Application to amend the Lockheed Site and Master Use Permit as it relates to the development of Parcel 18.

1998-0621 – Application for a Variance from Sunnyvale Municipal Code Section 19.04.130(6) requiring that a lot have frontage on a public street.

1998-0620 – Application for a Tentative Map for Parcel 18 to allow a 5 lot subdivision.

2. 1998-0543 – Alex and Rita Bauer: Appeal of a decision by the Director of Community Development denying the removal of a Deodar Cedar tree. The property is located at 992 Edmonds Way in an R-1 (Low Density Residential) Zoning District. (APN: 320-18-014) GL

B.    Pre-Appeal of the Administrative Hearing Agenda of August 12, 1998

1.    1998-0590 – Alan and Rosemary Liu (Harvey Nguyen): Application for a Special Development Permit to allow a 475 sq. ft. addition to the rear of the structure resulting in a lot coverage of 42% where 40% is allowed by code. The property is located at 1034 Ahwanee Avenue in an R-2/PD (Low-Medium Density Residential/Planned Development) Zoning District. (APN: 205-07-054) GL

2. 1998-0646 – Susan and Douglas Van Den Broeke: Application for a Variance from Sunnyvale Municipal Code 19.44.020 to allow a front yard setback of 4 feet where 20 feet is required to allow construction of a garage. The property is located at 917 Mockingbird Lane in an R-0 (Low Density Residential) Zoning District. (APN: 198-10-021) GL

3. 1998-0705 – Ahron and Barbara Bogomilsky Trustee (Thompson Toyota, Inc.) Application for a Special Development Permit to allow an automobile broker with used car sales lot. The property is located at 815 E. El Camino Real in a C-2/PD (Highway Business/Planned Development) Zoning District. (APN: 211-16-026) BRS

RECOMMENDATION

The Council should review the agenda and appeal an application where appropriate.
